The attorneys and staff of MartinWren, P.C. are pleased to announce that trial attorneys John B. Simpson and Robert E. Byrne, Jr. obtained a substantial jury verdict in a hard fought business litigation dispute. John and Bob represented a government contractor that was sued in a lawsuit seeking nearly $3 million in damages. The lawsuit, filed by a former partner of the government contracting client, claimed that the defendant committed fraud and breached an asset purchase agreement that existed between the parties. Our client filed a counterclaim against the former partner and his company, claiming that the partner and his company breached the Asset Purchase Agreement and caused our client to incur significant attorneys’ fees and other legal costs to defend the claim.
The case was tried before a jury in the Circuit Court for Albemarle County over the course of four days. The jury heard testimony and viewed evidence from several witnesses. Four expert witnesses, including certified public accountants and a business valuation expert, all testified. In an unusual move, the plaintiffs called a well-respected retired federal magistrate judge to testify about the credibility of the former partner who was pursuing the lawsuit.

The jury deliberated for approximately two hours before reaching a unanimous verdict for our client. Not only did the jury rule for our client on the defense of all of the claims, but the jury also ruled in our client’s favor on the counterclaim. At a later hearing, the trial judge awarded our client a total of $429,000 in attorneys’ fees and costs, with our client receiving $394,607.50 in attorneys’ fees and $35,000 in costs.
